Oklahoma Liquor Licensing Guide

The following information should help you with understanding, pursuing, and obtaining the liquor license that you need. It should also help you understand the overall process of obtaining a license and explain the various types of licenses available.


LICENSE TYPES

RETAIL LICENSES (Off-Premise)
Retail Beer License

What It Covers
Sale of beer (full-strength, any ABV) for off-premise consumption. Typical venues: package stores, grocery stores, convenience stores, gas stations.

Annual Fee: $500

Typical Timeline: 60–90 days

Key Restrictions

  • Off-premise sales only (customers purchase and leave premises)
  • No on-premise consumption (no bar seating, no tables for drinking)
  • Age verification mandatory (ID required for all beer purchases)
  • Cannot sell spirits without separate Retail Spirits License
  • Must comply with local city/county zoning and any additional local restrictions
  • Hours of operation set at time of licensure and enforced by ABLE

Retail Wine License

What It Covers
Sale of wine only (no beer, no spirits) for off-premise consumption. Venues: wine shops, grocery stores, specialty retailers.

Annual Fee: $1,000

Typical Timeline: 60–90 days

  • Wine only—no beer or spirits
  • Off-premise consumption only
  • Age verification mandatory (21+)

  • Cannot serve wine on-premises without separate on-premise license

Retail Spirits License

What It Covers
Sale of spirits (liquor), wine, and beer for off-premise consumption. This is the broadest retail license.

Annual Fee (Population-Based)

  • Cities 200–2,500: $305
  • Cities 2,501–5,000: $605
  • Cities over 5,000: $905

Typical Timeline: 60–90 days

Key Restrictions

  • Off-premise sales only (no on-premises consumption)
  • For on-premise service, separate Mixed Beverage License required
  • Spirits cannot be sold in bulk (must be sealed containers)
  • Age verification mandatory
  • Local zoning compliance required
  • Dram shop liability applies if spirits sold to visibly intoxicated persons

ON-PREMISE LICENSES (Bars, Restaurants)
Mixed Beverage License (Full Bar)

What It Covers
Sale of beer, wine, and spirits for on-premise consumption only. Venues: restaurants, bars, nightclubs, lounges. Most comprehensive on-premise license.

Annual Fee

  • Initial: $1,005 + $500 admin = $1,505
  • Renewal: $905 + $500 admin = $1,405

Typical Timeline: 60–90 days

Key Restrictions

  • On-premise consumption only (customers drink at bar/tables on premises)
  • Cannot sell off-premise spirits without separate Retail Spirits License
  • Dram shop liability applies
  • All staff must hold valid ABLE employee licenses
  • Must comply with open container laws
  • Hours of operation enforced per license

Tax & Compliance Notes

  • Mixed Beverage Tax Permit required from Oklahoma Tax Commission (~$50–$100 fee)
  • Sales tax permit required
  • Monthly tax reporting to OTC
  • Regular ABLE compliance inspections

Annual Fee: $500 (much lower than Mixed Beverage License)

  • All staff must have ABLE employee licenses

  • No open containers outside premises

CATERER & SPECIAL EVENTS
Caterer License

What It Covers
Sale and service of alcoholic beverages (beer, wine, spirits) incidental to food service at unlicensed premises. Weddings, corporate events, private parties.

Annual Fee: $1,250

Typical Timeline: 30–60 days

Key Requirements

  • Alcohol must be incidental to food service (food is primary)
  • Alcohol cannot be primary purpose/focus of event
  • Event venue cannot already hold its own ABLE license
  • All servers/bartenders must hold valid ABLE employee licenses
  • License permits alcohol service at multiple events throughout the year

Who Can Apply: Catering companies, event planners, individuals providing catering services.

Special Event License (One-Time)

What It Covers
Temporary alcohol service at a single event. Concerts, festivals, fundraisers, charity galas.

Fee Per Event: $255

Duration: Valid for a single event lasting up to 10 days

Typical Timeline: 5–10 business days (fast-track)

Key Requirements

  • One-time use only (event cannot be recurring without separate license)
  • Event duration: up to 10 consecutive days maximum
  • All servers must have ABLE employee licenses or temporary permits
  • Organizer responsible for compliance (age verification, no serving intoxicated persons)
  • Venue must allow alcohol service

Common Uses: Music festivals, community fundraisers, outdoor beer/wine gardens, sporting events, charitable galas, street fairs/markets.

Who Can Apply: Event organizers, nonprofits, schools, community organizations, anyone hosting a specific event.

MANUFACTURING & WHOLESALE
Brewer License

What It Covers
Manufacture, bottling, and packaging of beer. Sale to licensed wholesalers and/or on-premises consumption.

Annual Fee: $1,250

Key Requirements

  • Physical location must be in Oklahoma
  • Cannot sell directly to consumers (retail); must use licensed wholesaler
  • Brewpub License ($1,005 additional) allows on-premises sales of own beer
  • Beer must meet federal and state labeling requirements
  • Must maintain production records
  • Subject to federal TTB regulations

Self-Distribution Option: Small Brewer Self-Distribution License ($750) allows small breweries (≤15,000 barrels/year) to self-distribute to retailers.

Who Can Apply: Individuals, corporations, partnerships with appropriate brewing facility in Oklahoma.

Small Brewer License

What It Covers
Beer manufacture for breweries producing ≤15,000 barrels annually.

Annual Fee: $125 (90% savings vs. full Brewer License)

Self-Distribution Option: Small Brewer Self-Distribution License ($750) allows distribution to retailers without wholesaler.

Who Can Apply: Small brewing operations in Oklahoma.

Distiller License

What It Covers
Manufacture and distillation of spirits (liquor, whiskey, vodka, etc.). Sale to licensed wholesalers only.

Annual Fee: $3,125

Key Requirements

  • Physical location must be in Oklahoma
  • Spirits must be sold to licensed wholesalers only
  • Federal TTB permitting required (60–180 days additional)
  • Stringent federal safety and record-keeping requirements
  • Bonded warehouse storage required (unless exempt)

Who Can Apply: Individuals, corporations with distillery facility in Oklahoma.

Winemaker License

What It Covers
Production of wine (fermented grapes or other fruit). Sale to wholesalers or direct-to-consumer shipping.

Annual Fee: $625

Self-Distribution Option: Winemaker Self-Distribution License ($750 additional) allows self-distribution to retailers (≤10,000 gallons/year).

Small Farm Winery License: $75/year for small/hobby wineries producing ≤5,000 gallons annually.

Who Can Apply: Individuals, wineries, orchards, farms in Oklahoma.

Beer Distributor License

What It Covers
Wholesale purchase and distribution of beer from manufacturers/brewers to retailers.

Annual Fee: $750

Key Restrictions

  • Can only distribute beer (not wine or spirits)
  • Must purchase from licensed brewers/manufacturers
  • Can only sell to licensed retailers
  • Cannot sell directly to consumers
  • Subject to territorial/franchise laws

Who Can Apply: Distributors, supply companies, wholesalers in Oklahoma.

Wine & Spirits Wholesaler License

What It Covers
Wholesale distribution of wine and spirits from manufacturers to retailers and on-premise establishments.

Annual Fee: $3,000

Key Restrictions

  • Wine and spirits only (no beer; requires separate Beer Distributor License)
  • Must purchase from licensed distillers, winemakers, and nonresident sellers
  • Can only sell to licensed retailers and on-premise establishments
  • Cannot sell directly to consumers
  • Subject to state franchise/territorial laws

EMPLOYEE & MISCELLANEOUS LICENSES
Alcohol Beverage Employee License

What It Covers
Required for any individual who sells, serves, mixes, or handles alcoholic beverages in any licensed establishment.

Age Requirements

  • 16+ to work in off-premise retail
  • 18+ to serve or handle beer/wine in bars
  • 21+ to serve or handle spirits

Fee: Minimal (typically $10–$30 for course + state registration)

Brewpub License

What It Covers
Brewery with on-premise bar/taproom/restaurant serving own brewed beer directly to customers.

Annual Fee: $1,005 (in addition to Brewer License: $1,250). Total: $2,255 annually

Key Requirements

  • Must hold valid Brewer License first
  • Bar/taproom can only serve beer brewed on-premises
  • Cannot serve wine or spirits (unless separate Mixed Beverage License obtained)
  • Food service strongly recommended
  • All staff must hold ABLE employee licenses

Who Can Apply: Breweries wishing to operate a public bar/taproom.

Hotel Beverage License

What It Covers
In-room mini-bar service in hotels. Sale of small-format spirits, wine, and beer from mini-bars in guest rooms.

Annual Fee: $500+ (exact amount varies; check ABLE)

Key Requirements

  • Sealed, original format beverages only
  • Limited to mini-bar in guest rooms (not public bar)
  • Room service staff must verify guest age before service
  • Hotel liable for service to minors or intoxicated guests
  • Record-keeping for inventory and sales required

Key Regulations & Compliance

Public Consumption Prohibition
It is illegal to consume or inhale intoxicating beverages in public in Oklahoma. Punishment: $10–$100 fine and/or 5–30 days imprisonment. Applies statewide; local ordinances may be stricter.

Dram Shop Liability
On-premise licensees and individual servers are legally liable if they serve alcohol to minors (under 21), visibly intoxicated persons, or persons who subsequently cause injury, death, or property damage. Best Practice: Train all staff in responsible beverage service; verify ID; refuse service to intoxicated patrons.

Age Verification

  • All staff must verify ID for all alcohol sales
  • Acceptable ID: Driver's license, passport, military ID, state ID
  • Selling alcohol to minors is a criminal offense (felony for repeat offenders)
  • Penalties: Fine up to $500, license suspension/revocation, criminal record

Tax Permits & Filing

  • Mixed Beverage Licensees: Must obtain Mixed Beverage Tax Permit from Oklahoma Tax Commission (~$50–$100 fee)
  • Sales Tax Permit: Required for all alcohol sales
  • Monthly tax reporting: Mixed beverage taxes due monthly to OTC
  • Excise tax: State excise tax on beer, wine, and spirits applies to all sales

Employee License Requirement

  • All staff handling alcohol must obtain ABLE Employee License (valid 2 years)
  • Must complete state-approved Responsible Beverage Service training
  • Training must be completed within 14 days of employment
  • Failure to obtain license: employer liable for violations

Compliance Inspections

  • ABLE conducts regular announced and unannounced inspections
  • Inspectors verify: valid licenses on display, age verification procedures in place, proper storage and handling, no sales to minors or intoxicated persons, compliance with hours of operation
  • Violations result in fines, suspension, or license revocation

Local Ordinances
In addition to state ABLE regulations, cities and counties may impose additional restrictions: zoning limitations, hours of operation (local may be stricter than state), distance from schools or residential areas, special permits or approvals. Always check with local city/county before applying.

Important Note: Oklahoma has NO dry counties. As of June 2018, all 77 Oklahoma counties permit the sale of liquor by the drink for both on-premise and off-premise consumption.
